Last Expert Gives Testimony in China Arnold Case Cathy Stelzer, Reporter POSTED: 12:50 pm EST January 15, 2008 UPDATED: 2:24 pm EST January 15, 2008 DAYTON, Ohio -- The last of three expert witnesses gave testimony Tuesday in a pre-trial hearing for China Arnold. Now, Montgomery County Common Pleas Judge John Kessler must decide if their testimony will be heard during trial. Three experts have given testimony in the last week in the case of China Arnold, the Dayton mother accused of killing her newborn daughter, Paris Talley, in a microwave oven. The third and final expert to testify Tuesday was Doctor George Nichols, a forensic pathologist for the defense. Dr. Nichols disputed claims by a prosecution expert that China Arnold's daughter died after being burned in the microwave for as long as two minutes back in 2005. Dr. Nichols disputed an experiment by the prosecution that used a chicken's body and calves brains in a microwave to simulate the deadly injuries to the baby girl. Over the past week, three experts have offered opinions at the hearings--two for the defense, and one for the prosecution. Judge John Kessler is expected to issue a written ruling Friday to determine if all, some or none of the experts will testify at China Arnold's murder trial, set to begin Jan. 28. During opening statements Thursday, prosecutors told the jury that Arnold confessed to police, and that she even described how the infant "fit right in." Mistrial declared in microwave baby case By JAMES HANNAH, Associated Press Writer 2 hours, 19 minutes ago DAYTON, Ohio - A judge declared a mistrial Monday in the case of woman accused of killing her month-old baby by burning her in a microwave, finding that new defense witnesses bolster her claim that she is innocent. Judge John Kessler made the decision after hearing testimony privately from a juvenile who said he was at the apartment complex of defendant China Arnold on the night her infant died in August 2005. The judge did not give details about the juvenile's testimony. Arnold showed little emotion when the judge announced his decision but appeared sad as she walked out of the courtroom and was returned to jail. Family members in the courtroom had no audible reaction but hugged one another in the hall as they were leaving. Kessler continued a gag order in the case, so neither prosecutors nor defense attorneys would comment. The judge had also heard testimony from the father of the juvenile who said he was at the complex and was presented with affidavits from an adult witness. Prosecutors asked Kessler to reject the evidence, questioning its truthfulness, the judge said. But Kessler said that the evidence is new and that the defense hasn't had a chance to investigate it. Ordering the trial to move forward without considering the evidence would be instant grounds for reversal of any conviction, Kessler said. And allowing the evidence during the final stages of the trial would prevent prosecutors and defense attorneys for a full opportunity to investigate it and affect how Arnold chose to confront other witnesses, he said. Kessler discharged the jury and ordered the case placed back on the court docket for further scheduling. Police investigators believe Arnold killed the girl, Paris Talley, by putting her in a microwave at her Dayton home. China Arnold, 28, is charged with aggravated murder in the 2005 death of her daughter, Paris Talley, and could face the death penalty if convicted. She has pleaded not guilty. Her retrial in Montgomery County Common Pleas Court comes six months after a judge declared a mistrial in her initial trial, saying new evidence had surfaced to bolster Arnold's innocence claim. Visiting Judge John Kessler declared the mistrial Feb. 11, just as closing arguments were to begin, after he privately heard testimony from a juvenile who said he was at Arnold's apartment complex the night the baby died. The judge did not give details about the juvenile's testimony. The Dayton Daily News reported that a man had told defense attorneys his 5-year-old son claimed to have found the baby in the oven and pulled her out. The newspaper said the boy identified an older child as the person who may have put Paris Talley in the oven. Assistant Montgomery County Prosecutor David Franceschelli called defense claims that someone else may have been responsible a "fanciful" account contradicted by evidence. Both prosecutors and defense attorneys have been barred by the court from talking publicly about the case. During Arnold's first trial, prosecution witnesses said she admitted killing the baby by putting her in the microwave. Arnold did not testify, but defense witnesses said she told them she had nothing to do with the baby's death, didn't know how it happened and had expressed shock when told the child may have been burned in a microwave.
