Felony child abuse charges were filed Thursday in Woods County District Court against William James Oakes and Melissa Oakes. Melissa Oakes was charged with one count of Child Endangerment by permitting child abuse, and two counts of injury of minor child.
William James Oakes was charged with 10 counts of lewd molestation, 10 counts of rape by instrumentation, second degree, three counts of forcible sodomy, five counts of first degree rape by force, and four counts of injury to a minor child.
MOTHER CHARGED
Melissa Oakes is charged with a felony for knowingly permitting physical abuse to a minor child perpetrated by the child’s step-father. This charge carries a penalty of $5,000 and/or imprisonment in the state penitentiary up to four years.
The second count charges the mother with “willfully or maliciously injuring, torturing, maiming or using unreasonable force upon a minor female child, who was eight or nine years old at the time, by forcibly striking the child with a vacuum cord held in her hands causing extensive bruising.” This charge carries a fine of $500 to $5,000 or imprisonment in the state penitentiary not exceeding life or by imprisonment in county jail not exceeding one year, or by both fine and imprisonment.
The third count accused Melissa Oakes of forcibly striking the child with a belt buckle held in her hands causing extensive bruising. This carries the same penalty as count 2.
The affidavit accompanying these charges states that Special Agent Chuck McAnarney of the Oklahoma State Bureau of Investigation from the Woodward office investigated the case after the Oakes family was referred to the Department of Human Services in 2001.
“Before DHS could intervene, Melissa Oakes convinced (the children) not to tell DHS about the abuse and give William James Oakes two more chances.”
Agent McAnarney stated that although the abuse was reported to Mrs. Oakes, the abuse continued several times. McAnarney said the mother was present when William James Oakes spanked the children with an electrical cord off the vacuum cleaner and the buckle end of a belt. He stated the mother had also spanked the children with those same items.
McAnarney stated in the affidavit that the sexual activity on the female child had been confirmed after an examination by Dr. Janice Chleboard.
STEP-FATHER CHARGED
Lewd molestation charges against William James Oakes, 24, for improper touching of the teenage female are alleged to have occurred between May 2006 continuing through July 2006. These charges carry a penalty of imprisonment from 1-20 years.
During the same period, Oakes was charged with 10 counts of rape by instrumentation. The penalty for these charges is not less than 1 year nor more than 15 years incarceration.
Charges accuse Oakes with three counts of forcible sodomy and anal copulation from 1998 to 2004. These charges carry a penalty of up to 20 years incarceration and up to $10,000 fine for each count. Rape charges date from May 1998 to June 2005. The penalty for each count is not less than 5 years incarceration. In addition, Oakes is charged with willfully or maliciously injuring, torturing, maiming or using unreasonable force on the minor male child who was 6 or 7 years old at the time and the female minor child who was 8 or 9 years old at the time.
These charges carry a fine of $500 to $5,000 or imprisonment in the state penitentiary not exceeding life or imprisonment in the county jail not exceeding one year, or by both fine and imprisonment.
The next court appearance date for both Melissa and William James Oakes is September 12, 2006.
