Lindsey Bruce DNA to be used in trial
Even in death Emily left her trace
of evidence against Bruce.
His attorneys had hoped to supress
DNA taken from Bruce during the
investigation of her disappearance.
But a judge ruled it can be used and
that there is no double jeopardy in
the case that will begin in February
of 2007.
Since Bruce was only convicted of the
charge he currently is in prison on and
nothing of this charge was ever brought
forward in that case the judge ruled he
could stand trial and that Emilys DNA
that was taken from pubic hairs of the
defendant could be used.
Emilys skull was found this year by a
fisherman. Officials had looked for her
after her disappearance, but had no luck
in locating her.
Bruce had taken her just before Christmas
in 2005, from her home where she slept.
He was convicted this year for his role in
Emilys disappearance. He has never been
charged with her murder to date, but that
could change depending on the out come
of this case.
