Town rocked by arrest of Sunday school teacher TRACY, Calif. – Police and residents were shocked when the suspect in the killing of an 8-year-old girl found stuffed into a suitcase turned out to be a woman, the mother of the slain girl's best friend. The motive in the killing had not been determined. Melissa Huckaby, a Sunday school teacher and granddaughter of a minister, was on suicide watch at the San Joaquin County Jail, where she remained in custody Sunday without bail on suspicion of kidnapping and killing Sandra Cantu. Sandra's body was found in Huckaby's suitcase in an irrigation pond nearly a week ago, police said. "This was an anomaly in the murder of a child," police Sgt. Tony Sheneman said at a news conference Saturday in this northern California town. "Finding out that it is a woman who is responsible for Sandra's kidnapping and murder, and then finding out it is a member of the community is another blow." FBI statistics show women are involved in just 7 percent of murders of any sort. Solo killings of children by women are even more unusual. "It's very unusual for women to be involved in an abduction and murder of a child," said Candice DeLong, a retired FBI profiler based in San Francisco. "Sometimes we see this when the woman is working with a male partner. It does not appear to be the case this time. But this was not a sexually motivated crime." Sandra disappeared on March 27 and hundreds of volunteers and law enforcement officials turned out to search for her. Pictures of the girl with dark brown eyes and light brown hair were posted all over Tracy, a city of 78,000 people about 60 miles east of San Francisco. Police said they received 1,500 tips. Huckaby, 28, had attended the second of several vigils for the slain girl, Sheneman said. Police would not say where or how the girl was killed, though investigators said they believed she died very soon after she was last seen. Autopsy results are not yet available, and investigators declined to say whether they believe the slaying was accidental or deliberate. Inconsistencies in Huckaby's story led to her arrest, Sheneman said. There are no other suspects and no other arrests are expected, he said. Her arraignment is scheduled for Tuesday. Several of Huckaby's relatives appeared briefly before reporters Sunday. One man, who would only describe himself as a member of the family, read a statement saying the allegations against Huckaby were completely out of character. The man was joined by several other relatives, including Huckaby's grandfather, Clifford Lawless, who is pastor of the nearby Clover Road Baptist Church, which was searched by authorities after Cantu's body was discovered. Huckaby taught Sunday school at the church and lived with Lawless in the Orchard Estates Mobile Home Park that also was Sandra's home. Huckaby's uncle, John Hughes Jr. of Whittier, told The Associated Press his niece was from a good home, but had hit a rough patch in her life and had moved in with her grandparents in Tracy to get past her troubles. "They opened their home up to her to try to get her life back on track. I think a lot of families have problems like that," Hughes said. Huckaby grew up in Orange County and was a "pretty normal kid," he said. As the eldest of nine grandchildren, she played "mother hen" to the younger children when the family got together for the holidays. After graduating from high school, Huckaby's path appears to have become rockier. She married, had a daughter and was divorced in a few short years. She had difficulty finding and keeping a job, partly owing to the challenges of single motherhood, Hughes said. "She's had her struggles," he said. "But there's no way (her grandparents) or anybody would be fearful that anything this horrifying could possibly come from that." Huckaby had been scheduled to appear in court on April 17 to check in with a county mental health program as part of a three-year probation sentence for a petty theft charge to which she pleaded no contest. She was arrested late Friday, about five hours after she drove herself to the local police station at the request of officers. "She was calm, cool and collected, then she became very emotional," Sheneman said. It was not immediately clear if Huckaby had hired an attorney to speak for her. She had worked as a checker at a Food for Less grocery store in a strip mall just east of the mobile park for nearly four years, until she was fired sometime in 2004, said Matt Duncan, an assistant manager at the store now known as FoodMaxx. "I wouldn't have anything bad to say about her, until now," said Duncan, who has worked at the store off and on for about 10 years. Rape may be alleged in Sandra Cantu killing Monday, April 13, 2009 SAN FRANCISCO (AP) -- Prosecutors said Monday they may include rape and molestation allegations in their murder charge against the woman suspected of killing an 8-year-old Northern California girl and putting her body in a suitcase. Melissa Huckaby, 28, was arrested Friday on suspicion of kidnapping and murdering Sandra Cantu. San Joaquin County Deputy District Attorney Robert Himmelblau told The Associated Press Monday that a homicide charge against Huckaby could also include the special circumstances of rape with a foreign object, lewd and lascivious conduct with a child and murder in the course of a kidnapping. A conviction on any of the special circumstances would make Huckaby eligible for the death penalty or life in prison without parole, Himmelblau said. The district attorney has not determined whether his office will seek the death penalty in the case, he said. Sandra disappeared March 27. She was last seen on surveillance video skipping near her home at the Orchard Estates Mobile Home Park in Tracy. A 10-day search ended April 6, when farmworkers draining a nearby irrigation pond found a suitcase that contained her remains. Himmelblau wouldn't provide additional details on any evidence leading prosecutors to consider the sexual assault allegations. Police have not released any details on how, where or why Sandra was killed. "I was hoping that wasn't the case," said Sandra's aunt, Angie Chavez, regarding the possibility of rape and molestation allegations. "I'm in shock," she said through tears. "The whole thing is unimaginable." Formal charges have not yet been filed against Huckaby. A final decision on which special circumstances to include has not been made, Himmelblau said. Huckaby is scheduled to be arraigned Tuesday in Stockton. Himmelblau was not aware if Huckaby had an attorney. Himmelblau said prosecutors were considering filing other charges against Huckaby but declined to specify what the additional charges may be. She remained in custody without bail in San Joaquin County jail Monday where jail staff have been monitoring her mental health. She's not been allowed visitors. Tracy police did not immediately return messages seeking comment. Three new charges against Huckaby Tracy woman accused of poisoning two, including a 7-year-old girl By Scott Smith Record Staff Writer May 22, 2009 6:00 AM STOCKTON - Prosecutors on Thursday filed three additional felony counts against Melissa Huckaby, charging her with poisoning two people, including a 7-year-old girl and an adult man. The girl lived in the same Tracy mobile home park as the slain Sandra Cantu. Huckaby, 28, is expected to appear in San Joaquin County Superior Court today for further arraignment on previous charges that she kidnapped, raped and murdered 8-year-old Sandra on March 27 before dumping the girl's body in an irrigation pond north of Tracy. Huckaby's attorney, Sam Behar, was expected to enter a plea on his client's behalf at today's hearing, but the new charges could lead to a change in the defense strategy. The new complaint charges Huckaby with a single count of child endangerment and two felony counts of furnishing a harmful substance, which is not identified in the document. In both counts of alleged poisoning, the complaint says Huckaby "did willfully and unlawfully mingle a harmful substance with food or drink with the intent that (it) be taken by a human being." The complaint charges Huckaby with poisoning the 7-year-old girl, identified only as Jane M. Doe, on Jan. 17, the same day a woman in the Orchard Estates Mobile Home Park - where both Sandra and Huckaby lived - reported to Tracy police that Huckaby returned her daughter drugged with a muscle relaxant. In the second poisoning charge, Huckaby allegedly drugged a man identified as Daniel Plowman on March 2 - 21/2 months after the first alleged poisoning and 25 days before Sandra was reported missing. Her body was found April 6. Plowman's relationship with Huckaby is unclear, and his whereabouts are unknown. He could not be located for comment Thursday. The complaint doesn't give his age or any details of the alleged poisoning. A judge's gag order prevents attorneys, investigators and potential witnesses from talking to the media. Report: Melissa Huckaby's attorney to ask judge to dismiss indictment By Sophia Kazmi Contra Costa Times Posted: 10/30/2009 07:14:12 AM PDT Updated: 10/30/2009 11:55:40 AM PDT STOCKTON — The Tracy woman accused of killing 8-year-old Sandra Cantu is expected to return to court today, where her attorney is expected to update the judge on his progress preparing her defense. The Stockton Record is reporting that Sam Behar, the public defender appointed to represent Melissa Huckaby, is expected to ask the judge to throw out the indictment against her, and has filed court papers criticizing Tracy police investigators who arrested Huckaby. Behar has also enlisted the help of veteran death penalty attorney Michael Burt, of San Francisco, in the case, the Record reported. Burt has been involved in the defense cases of Lyle Menendez, Charles Ng and Cary Stayner, among others, the newspaper said. A grand jury has indicted Huckaby, 28, on murder with three enhancements — kidnapping, lewd and lascivious acts on a child under 14 and rape by instrument — in connection with the girl's death. A second count charges Huckaby with a sex crime with a child 10 years or younger. Huckaby has also been indicted on two counts of furnishing a harmful substance and one count of child endangerment for two unrelated drugging cases involving another Tracy girl and a Hayward man. She has pleaded not guilty to all counts. The San Joaquin County District Attorney's Office will seek the death penalty if Huckaby is convicted. A gag order prevents attorneys involved from publicly commenting. In court today, Behar and Huckaby are expected to meet privately with the judge presiding over the case before the hearing reconvenes in open court. Tracy police arrested Huckaby on April 10, four days after Sandra's body was found stuffed in a suitcase and submerged in a pond not far from the Orchard Estates Mobile Home Park, where Huckaby and Cantu lived. Behar was victorious at last month's hearing, when he asked for and received more time before a date was set for Huckaby's trial. Deputy District Attorney Thomas Testa, who is prosecuting the case, pushed for a trial date as soon as possible. After hearing Behar privately on Sept. 25, Judge Linda Lofthus set two court dates for Behar to update the court on the progress of his preparation. Today's court date is the first of two. The second hearing is set for Dec. 4, when a trial date may be set. Testa was pushing for a trial date because the memories of the children who will be called to testify — the alleged victim of the drugging and Sandra's friends — fade with time. He has said the defense has had ample time to prepare for trial. Cantu, a second-grader, was last seen alive March 27. A 10-day search ensued that received national attention. Before she was arrested, Huckaby told a Tracy newspaper that she owned a suitcase similar to the one Sandra was found in. Huckaby said her suitcase disappeared the same day Sandra did.
