Durham DA Blames His Office For Mistaken Dismissal Of Child Rape Case District Attorney Insists Error Will Not Affect Case's Prosecution POSTED: 4:31 pm EST January 16, 2006 UPDATED: 7:40 pm EST January 16, 2006 DURHAM, N.C. -- Durham County's district attorney says a clerical error is to blame for charges against an accused child rapist being dismissed by his office. In February 2004, police arrested and charged Norman Brooks in the alleged molestation and rape of Bobby Parker's young daughter. But in September 2005, the charges against Brooks were dropped and the case was dismissed. "This is clearly the fault of this office," said Durham County District Attorney Mike Nifong. The case was originally assigned to Assistant District Attorney Tracey Cline, who was also handling another case against Brooks that was considered to be much weaker than the sexual abuse case. The district attorney's office was planning to drop the weaker of the two cases. "In the course of entering the dismissal, inadvertently the wrong number was placed on the dismissal," Nifong said. Then, Cline went on medical leave, and Parker was told that his daughter's case would be reassigned to Assistant District Attorney Jan Paul. But when Parker called Paul last week, he said she told him that she was not aware of the case. "I was like, 'Did you lose the file? Why don't you know anything about the case?' I just couldn't understand," Parker said. Nifong said Paul had been assigned to many cases, but Parker's daughter's case was not one of them. "Unfortunately, we made a second mistake," Nifong said. Nifong, however, insists the mistakes will not affect the prosecution of the case. It has since been assigned a new prosecutor and Nifong assures WRAL that it will go before the grand jury for indictment on Tuesday. Still, Parker has little faith left and wonders if his daughter's case will ever make it to court. "It's my job to protect her and take care of her and I was thinking the district attorney's office was going to do their job, too," he said. As for his daughter, Parker said she has been in therapy and is doing well. WRAL

Accused Child Molester Indicted After Charges Mistakenly Dropped Posted: Jan 17, 2006 DURHAM, N.C. — A Durham grand jury on Tuesday indicted an accused child molester, months after the Durham disctrict attorney's office mistakenly dropped charges against him. Norman Brooks was indicted on eight counts, including statutory rape and taking indecent liberties with a child. Brooks was originally arrested two years ago, but last fall an assistant district attorney mistakenly dropped the charges against him. Youth Leader Norman Brooks Charged with Indecent Assault of Child Posted on May 25, 2008 by dannimoss This story courtesy of NBC10.com ~~~ A youth group leader from a local church has been arrested, accused by prosecutors of inappropriately touching a 13-year-old girl. Members of the Carmel Presbyterian Church found it difficult to believe an employee there was arrested. “I’m surprised, a little disappointed if it is true,” Denise Bottinger, a church member, said. Montgomery County prosecutors charged 61-year-old Norman Brooks with indecent assault. Investigators said Brooks inappropriately touched a 13-year-old girl. Investigators said Brooks was the girl’s church youth group leader in Abington. Investigators said Brooks assaulted the girl on nine different occasions between January and April of this year. Police said Brooks admitted some disturbing details. According a police report, Brooks told officers he touched the girls thigh twice at her home, while her unsuspecting mother was in the room. Police said he also admitted to touching the 13-year-old’s thigh in a car while driving her to a church breakfast. NBC 10 went to Brooks’ home for comment but no one came to the door and neighbors were reluctant to comment on camera. But one neighbor said that she feels for the family. Church members are still trying to digest the news about a man they said they’ve trusted with their children for years. “He is dedicated to the church and does a lot for the church. Hopefully things will work out and if he did do it then I hope he gets the help that he needs,” Bottinger said.
