Ordinance 165-05 for you Mayor Scott of Texas Thank You
Ordinance 165-05 An ordinance declaring that no person who has been convicted of, is convicted of, has pleaded guilty of, or pleads guilty to either a sexually oriented offense that is not a registration exempt sexually orie- nted offense or a child-victim/survivor oriented offense and has been classified as a sexual predator shall establish a residence or occupy residential premises within 2,500 feet of any school premises, day care facility, pre-school, public play ground, public park, public library, or a public swimming pool, private home owner association that is located within the City of Mansfield Texas. Be it Ordained by the Council of the City of Mansfield, County of__________, State of Texas: 1. That no person who has been convicted of, is convicted of, has pleaded guilty to, or pleads guilty to either a sexually oriented offense that is not a registration exempt sexually oriented offense or a child-victim/survivor oriented offense and has been classified a sexual predator shall not establish a residence or occupy residential premises, within private homeowners association, school, day care,pre-school, public play ground, public park, library, or public swimming area that is located within the City of Mansfield, State of Texas by 1,00 feet. 2. That if a person to whom Section1. of this ordinance applies violates Section1. of this ordinance by establishing a residence or occupying residential premises within 1,000 feet of any school, daycare, pre-school, public park, public play ground, library, private homeowners association, or swimming pool, that is located within the City of Mansfield State of Texas, the Law Director has a cause of action for injunctive relief against the person. The City of Mansfield shall not be required to prove irreparable harm in order to obtain relief. 3. That the City of Mansfield adopts the provisions of the law of Texas now or hereafter in effect concerning the definition, determination, registration, or classification of a person who has been convicted of, is convicted of, has plead guilty to,or pleads guilty to either a sexually oriented offense or a child victim oriented offense and has been classified a sexual predator. 4. That the City of Mansfield located in the State of Texas finds that because children are especially vulnerable to being victims of sexually abusive behavior, kidnapping, and even abduction, and are likely to be present a significant amount of time on or near these premises, school premises, day care premises, pre-school premises, publci park, public play ground, library, and private home owners association that certain persons convicted of, or have plead guilty to, a sexually oriented offense or child-victim/survivor offense and classified a sexual predator must not establish residence or occupy a residentail premises within 1,000 feet of any school, day care, pre-school, public park, public play ground, private home owners association, library, or swimming pool. 5. That the City of Mansfield in the State of Texas adopts the definitions now and hereafter in effect for schools, day care, pre-school, public park, public playground, library, public swimming pool, and private home owners association as defined by Texas Law. 6. That this is hereby declared to be the intentions of Council of the City of Mansfiled State of Texas that the sections, paragraphs, or sentences, clauses, or section of this order be declared unconstituional or other wise invalid by the valid judgement of decree of any court of competent jurisdiction, such unconstitutionally or invalidity shall not effect any of the remaining words, clauses, sentences, paragraphs, and sections of this ordinance, because the same would have been enacted by Council of the City of Mansfield in the State of Texas without the incorporation of this ordinance of any such unconstitutional or invalid word, clause, sentence, paragraph, or section. 7. That this ordinance shall take effect and be in full force from and after the earliest period allowed by law.
